2About the Operator & Platform

The Platform is operated by HUY PHAM, a business entity established and operating under the laws of the Socialist Republic of Vietnam. The Operator provides the Weight Management System 4.0 as a Software-as-a-Service (SaaS) platform and digital coaching service to users globally, including users located in Germany, Austria, Switzerland, and the wider European Union.

The service is offered as a digital subscription service delivered entirely online. No physical goods are sold or dispatched. All transactions are conducted in Euros (EUR) or Vietnamese Dong (VND) as specified at checkout.

3Editorial Responsibility §18 MStV

The person responsible for the content of this Platform pursuant to §18 Abs. 2 Medienstaatsvertrag (MStV) and applicable Austrian and Swiss media law is:

4EU Representative GDPR Art. 27

As a business established outside the European Union that offers services to EU consumers and processes EU personal data, HUY MINH has appointed an EU Representative pursuant to Article 27 of the GDPR and, where applicable, Article 13 of the Digital Services Act:

The EU Representative is authorised to receive communications from EU data protection supervisory authorities, courts, and consumers on behalf of HUY MINH. EU users may contact the EU Representative to exercise their data protection rights.

5VAT & Tax Information

Under EU Council Directive 2006/112/EC (as amended by Directive 2017/2455/EU), digital services supplied to EU consumers are taxable in the consumer’s country of residence. We apply the correct VAT rate for your country at the point of sale.

HUY PHAM is not a licensed medical provider. The Platform is operated as a digital wellness and lifestyle coaching service. Nothing on the Platform creates a doctor–patient relationship or any other regulated healthcare relationship between HUY PHAM and its users.

You should always consult a qualified physician, dietitian, or licensed healthcare professional before commencing any weight management programme, dietary change, or exercise regimen — particularly if you have or suspect any underlying medical condition, are taking prescription medication, or are pregnant or breastfeeding.

HUY PHAM expressly disclaims all liability for any harm, injury, or adverse health outcome that may result from reliance on information, recommendations, or content provided through the Platform. If you are experiencing a medical emergency, call your local emergency services immediately.

7Results Disclaimer

HUY PHAM makes no representation, warranty, or guarantee — express or implied — that use of the Platform will result in weight loss, improved health metrics, enhanced fitness, or any specific outcome. Individual results vary significantly and depend on factors entirely outside HUY PHAM’s control, including genetics, medical conditions, lifestyle choices, programme adherence, and individual metabolism.

Any testimonials, case studies, or before-and-after examples published on the Platform represent individual experiences and are not typical results. They are provided for illustrative purposes only and do not constitute a guarantee of similar outcomes.

8EU Right of Withdrawal 14 Days

The 14-day withdrawal period commences on the day you conclude the subscription contract. To exercise this right in time, you must send your withdrawal notice before the period expires via:

• Email to: info@24k.agency with subject “Right of Withdrawal”
• Account Settings → Subscription → Withdraw from Contract
• Post to: HUY PHAM, 99 Lang Ha, Dong Da, Hanoi, Vietnam

Upon valid exercise of the right of withdrawal, we will reimburse all subscription fees received, no later than 14 calendar days from the date we receive your notice, using the same payment method at no cost to you.

9Liability for Content & Links

9.1 Liability for Own Content

The content of this Platform has been compiled with reasonable care. However, HUY PHAM cannot guarantee the accuracy, completeness, or currency of all published content at all times. HUY PHAM is responsible for its own content in accordance with applicable law, but is under no obligation to monitor transmitted or stored third-party information.

9.2 Liability for External Links

The Platform may contain links to external third-party websites. HUY PHAM has no influence over the content of those websites and cannot accept liability for that external content. Linked pages were checked for possible legal violations at the time of linking; illegal content was not identifiable at the time of linking. Upon notification of an infringement, such links will be removed immediately.

All content, software, trademarks, logos, graphics, texts, images, and multimedia materials published on this Platform are subject to Vietnamese and international copyright law. Content created by HUY PHAM may not be reproduced, distributed, transmitted, displayed, published, or broadcast without prior written permission, except as permitted by applicable law.

Downloads and copies of content are permitted for personal, non-commercial use only. Should you be aware of a copyright infringement, please notify us and we will remove such content immediately upon becoming aware of any violation.

11Dispute Resolution

HUY PHAM is not obliged and generally not willing to participate in dispute resolution proceedings before a consumer arbitration board pursuant to §36 VSBG (Verbraucherstreitbeilegungsgesetz), except where participation is mandatory under applicable law or agreed on a case-by-case basis.

We strongly encourage consumers to contact us directly at info@24k.agency in the first instance. We commit to responding to all formal complaints within 15 working days.

12Applicable Law & EU Consumer Protections

This Legal Notice and any disputes arising from use of this Platform shall be governed by the laws of the Socialist Republic of Vietnam, without prejudice to the application of mandatory consumer protection provisions of EU Member State law in the consumer’s country of habitual residence.
